Some company or vessel information may constitute personal data when it identifies a representative, captain, crew member, sole trader or other individual.

Website and technical data

When you use the website, certain technical information may be collected, including your Internet Protocol address, browser type, device information, pages visited, referring website, cookie identifiers and consent preferences.

Further information is available in our Cookie Policy.

4. How we collect personal data

We normally collect personal data directly from you when you complete a form, submit an application, request crew, contact Navira or communicate with us.

In some cases, personal data may be provided by client companies, shipowners, vessel operators, recruitment partners, professional references or other parties involved in a recruitment or crew placement process.

Where personal data has not been obtained directly from you, Navira will provide the required information within the periods established by applicable data protection law.

5. Purposes and legal bases

Responding to enquiries

We process personal data to respond to messages, provide information, prepare proposals and handle requests submitted through the website or by email.

The legal basis is the performance of steps requested before entering into a contract, under Article 6(1)(b) of the General Data Protection Regulation, or Navira’s legitimate interest in responding to professional and business enquiries, under Article 6(1)(f).

Managing crew applications

We process applicant data to review applications, evaluate professional profiles, verify qualifications and documents, contact candidates and manage potential crew placement opportunities.

The legal basis is the performance of steps requested by the applicant before entering into a contract or professional relationship, under Article 6(1)(b) of the General Data Protection Regulation.

Presenting candidates to prospective employers or clients

Where relevant to a specific placement opportunity, Navira may share the necessary application data with shipowners, vessel operators, crew managers, recruitment partners or client companies interested in the candidate’s profile.

This processing is necessary to take steps requested by the applicant in connection with a potential employment, placement or professional relationship.

The receiving organisation may act as an independent data controller for its own recruitment and employment decisions.

Considering applicants for future opportunities

With the applicant’s separate consent, Navira may retain an application and the supporting documents for future crew opportunities.

The legal basis for this additional retention is consent under Article 6(1)(a) of the General Data Protection Regulation. Consent may be withdrawn at any time without affecting the lawfulness of processing carried out before its withdrawal.

Managing client and supplier relationships

We process the personal data of company representatives, vessel contacts, clients and suppliers to prepare proposals, manage services, coordinate crew requirements, administer contractual relationships, issue invoices and maintain business communications.

The legal basis is the performance of a contract, compliance with legal obligations and Navira’s legitimate interest in managing its professional relationships.

Legal compliance and claims

Personal data may be processed to comply with legal, accounting, tax, employment, maritime, immigration or regulatory obligations, and to establish, exercise or defend legal claims.

The legal basis is compliance with legal obligations under Article 6(1)(c) and Navira’s legitimate interest in protecting its legal rights under Article 6(1)(f).

Website security and operation

Technical data may be processed to maintain the security, availability and proper operation of the website, prevent misuse and record consent preferences.

The legal basis is Navira’s legitimate interest in protecting and operating its website. Optional analytics or similar technologies are used only where the visitor has provided consent.

6. Sensitive personal data

Applicants should not submit health information, criminal conviction information or other sensitive personal data unless Navira has specifically requested it and has explained the applicable legal basis.

If sensitive personal data is required for a specific position or legal obligation, Navira will provide additional information and apply the appropriate safeguards required by law.

7. Data recipients

Personal data may be accessed or received by:

  1. Authorised Navira employees and contractors who require access for their professional duties.
  2. Shipowners, vessel operators, crew managers, prospective employers, recruitment partners and client companies involved in a relevant crew placement process.
  3. Website hosting, email, cloud storage, document management, security and technical service providers acting on Navira’s instructions.
  4. Legal, accounting, insurance and professional advisers where access is necessary.
  5. Courts, regulators, tax authorities, maritime authorities, immigration authorities and other public bodies where disclosure is legally required.

Navira does not sell personal data.

8. International data transfers

Navira operates in an international industry. Some prospective employers, shipowners, vessel operators, recruitment partners, clients or technology providers may be located outside the European Economic Area.

Where personal data is transferred outside the European Economic Area, Navira will use a lawful transfer mechanism, such as an adequacy decision adopted by the European Commission, approved Standard Contractual Clauses with appropriate supplementary measures, or another mechanism permitted under Chapter V of the General Data Protection Regulation.

You may contact Navira to request information about the safeguards applicable to a specific international transfer.

9. Data retention

Crew applications and supporting documents are retained for the duration of the relevant recruitment or placement process.

Where the applicant has provided separate consent to be considered for future opportunities, the application and supporting documents may be retained for up to 24 months following the last meaningful contact with the applicant.

If the applicant withdraws this consent, the application will be deleted or anonymised unless continued retention is required for an ongoing process, a legal obligation or the establishment, exercise or defence of legal claims.

Client, supplier and contractual information is retained during the professional relationship and afterwards for the periods required by applicable accounting, tax, commercial and legal obligations.

General enquiries that do not result in a contractual or professional relationship will normally be retained for no longer than 24 months following the last meaningful communication.

Technical data and cookie information are retained for the periods described in the Cookie Policy.

When information is no longer required for active processing but must be retained due to a legal obligation or possible claim, it may be securely restricted until the applicable retention period expires.

10. Is providing personal data mandatory?

Fields identified as mandatory must be completed so that Navira can process the relevant request or application.

If required information is not provided, Navira may be unable to respond to an enquiry, assess an application, present a candidate for an opportunity or provide the requested service.

Applicants are responsible for ensuring that the information and documents they provide are accurate, current and relevant.

11. Automated decision making

Navira does not make decisions producing legal or similarly significant effects based solely on automated processing.

Recruitment and crew placement decisions involve human assessment.

Please include sufficient information to identify yourself and explain the right you wish to exercise. Navira may request additional proof of identity where reasonably necessary to prevent unauthorised access to personal data.

Requests will normally be answered within one month. This period may be extended where permitted by law due to the complexity or number of requests.

No online transmission or storage method can be guaranteed to be completely secure. Applicants should only submit documents requested and relevant to the application process.
